This Privacy Policy explains how Burke Digital LLC ("Burke Digital," "we," "us," or "our") collects, uses, shares, stores, and protects information in connection with Sacky (the "App"). Sacky is a sack sports app that allows users to create accounts, upload videos, follow other users, comment on videos, and receive AI-assisted analysis and scores for ranking and competitive features.

By using Sacky, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, do not use the App.

1. Scope of This Policy

This Privacy Policy applies to the Sacky mobile app, related websites, account systems, support communications, rankings, social features, video uploads, AI analysis features, and any related services operated by Burke Digital LLC.

This Policy does not apply to third-party websites, platforms, app stores, social networks, or services that we do not control, even if they link to or integrate with Sacky.

2. Information We Collect

2.1 Account Information

When you create or use an account, we may collect:

• Username
• Name
• Email address
• Password or authentication credentials, if applicable
• Optional school, team, group, or club affiliation, which may be user-submitted and may not be official or verified

2.2 User Content and Social Activity

Sacky includes user-generated content and social features. We may collect and process:

• Videos, clips, images, captions, comments, and other content you upload or post
• Profile information and public-facing account details
• Follow, follower, like, score, ranking, leaderboard, and interaction data
• Reports, flags, moderation decisions, appeals, and safety-related communications

2.3 Video, Camera, Photo Library, and Microphone Data

If you grant permission, the App may access your camera, photo library, video library, and microphone so you can record, upload, or share videos. We only access these features when needed for App functionality and subject to device permissions you control.

2.4 AI Analysis Data

Sacky uses artificial intelligence and related systems to analyze uploaded videos. This may include processing visual movement, video frames, timing, trick performance, motion patterns, and related metadata to generate scores, grades, rankings, feedback, or other performance outputs. AI outputs may be inaccurate, subjective, incomplete, or inconsistent.

2.5 Usage, Device, and Technical Data

We may collect technical and usage information such as:

• App interactions, feature usage, pages viewed, buttons tapped, and session activity
• Device type, operating system, app version, language settings, general region, and crash logs
• IP address, timestamps, approximate location inferred from device or network data, and diagnostic information
• Performance, fraud prevention, security, analytics, and error-reporting data

2.6 Payment and Subscription Information

If Sacky offers paid features, subscriptions, or in-app purchases, payments are generally processed by Apple or third-party payment/subscription providers. We may receive limited purchase-related information such as subscription status, product purchased, renewal status, transaction identifiers, and entitlement information. We do not receive full payment card numbers from Apple.

2.7 Information from Communications

If you contact us for support, submit feedback, report content, request deletion, or communicate with us, we may collect your email address, message content, attachments, and related information needed to respond.

3. How We Use Information

We use information to operate, protect, improve, and develop Sacky, including to:

• Create, maintain, authenticate, and secure user accounts
• Allow users to upload, view, share, comment on, follow, and interact with videos and accounts
• Generate AI-assisted scores, rankings, leaderboards, grades, feedback, and performance analysis
• Display user profiles, public content, comments, scores, rankings, and social interactions
• Moderate content, enforce rules, review reports, detect abuse, and protect users
• Provide customer support and respond to requests, complaints, or legal notices
• Improve App performance, reliability, safety, design, features, analytics, and user experience
• Manage subscriptions, paid features, entitlements, refunds, and purchase-related support
• Send service-related notices, policy updates, security alerts, and support messages
• Comply with laws, legal processes, and enforceable requests from government or legal authorities

4. User Content, Ownership, and Public Visibility

Users retain ownership of the videos and content they upload. However, content uploaded to Sacky may be visible to other users or the public depending on product settings, account settings, ranking features, sharing features, and how the App is configured.

By uploading content, you understand that other users may view, interact with, comment on, report, or share that content within or through the App. You should not upload content that you do not want others to see.

As described in the Sacky Terms of Service, uploaded content may also be used by Sacky and Burke Digital LLC for promotional, marketing, product, highlight, ranking, compilation, and App-related purposes, subject to the rights and license described in the Terms of Service.

Prohibited AI-Generated Content: Sacky is intended for authentic, real-world sack performances. Uploading AI-generated, AI-synthesized, deepfake, computer-generated, manipulated, or otherwise artificially created or altered videos that misrepresent real performances is strictly prohibited. We use automated systems, human review, and AI detection tools to identify such content. Users who upload AI-generated or artificially manipulated videos may have their content removed, scores invalidated, rankings reset, and accounts suspended or permanently banned without notice or refund.

5. AI Processing and Third-Party Infrastructure

Uploaded videos may be processed by AI systems to analyze movement, estimate performance, and generate grades or scores. This processing may involve third-party cloud infrastructure, AI providers, hosting providers, storage providers, or analytics providers acting on our behalf.

We use commercially reasonable efforts to work with service providers that process information for App-related purposes. AI analysis should not be treated as an official sport ruling, professional certification, medical evaluation, safety assessment, or guarantee of skill level.

6. How We Share Information

We do not sell your personal data. We may share information only as described below:

• With other users or the public when you upload content, comment, follow users, appear in rankings, or use social features
• With service providers that help us operate the App, including hosting, storage, analytics, AI processing, moderation, customer support, payment/subscription management, security, and email delivery
• With app stores, payment processors, and subscription providers as needed to manage purchases, subscriptions, entitlements, and refunds
• With legal authorities, regulators, courts, or other parties when required by law or when we believe disclosure is necessary to comply with legal obligations, enforce our terms, protect rights, protect users, prevent fraud, or address safety issues
• In connection with a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or transfer of all or part of our business, subject to appropriate protections where required by law
• With your consent or at your direction

7. Data We Do Not Sell

Burke Digital LLC does not sell users personal data. We do not sell user videos, emails, names, school or club affiliations, comments, follower data, or AI scoring data to data brokers.

8. Cookies, Analytics, and Similar Technologies

If Sacky uses websites, web dashboards, links, analytics tools, or similar technologies, we or our providers may use cookies, SDKs, pixels, local storage, or device identifiers to support login, measure performance, understand usage, prevent abuse, and improve the App. You may be able to limit certain tracking through device settings, browser settings, Apple privacy controls, or other platform controls.

9. Data Retention

We retain information for as long as reasonably necessary to provide Sacky, maintain accounts, provide social and ranking features, comply with legal obligations, resolve disputes, enforce agreements, prevent abuse, maintain security, and support legitimate business purposes.

When you delete your account or request deletion, we will take reasonable steps to delete or de-identify personal information, subject to legal, safety, backup, fraud prevention, dispute, accounting, and technical limitations. Some public or shared content may remain visible if it was copied, shared, featured, cached, incorporated into rankings, or retained as necessary for legal or safety reasons.

10. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no app, network, storage system, or transmission method is completely secure. Users are responsible for using strong account credentials, protecting their devices, and avoiding unauthorized account access.

11. Age Restriction

Sacky is not intended for people under the age of 13. By using the App, you confirm that you are at least 13 years old. We do not knowingly allow anyone under 13 to create an account or collect personal information from anyone under 13. If we learn that a user is under 13, we will take reasonable steps to remove their account and delete their information.

12. Your Choices and Rights

Depending on your location and applicable law, you may have rights to access, correct, delete, export, or object to certain processing of your personal information. You may also request account deletion or ask privacy-related questions by contacting us.

You can also control certain permissions, such as camera, photo library, microphone, notifications, and tracking preferences, through your device settings. Disabling permissions may limit App functionality.

13. State, National, and International Privacy Rights

Privacy laws may provide additional rights depending on where you live, including rights under state privacy laws or international privacy laws. If you make a rights request, we may need to verify your identity before responding. We will not discriminate against you for exercising privacy rights where prohibited by law.

13.1 CCPA / CPRA (California Privacy Rights)

Users in California have the right to access, delete, and request disclosure of their personal data. Users may request that we do not sell their personal information.
