This Privacy Policy explains how Burke Digital LLC ("Burke Digital," "we," "us," or "our") collects, uses, shares, stores, and protects information in connection with Sacky (the "App"). Sacky is a footbag sports app that allows users to create accounts, upload videos, follow other users, comment on videos, and receive AI-assisted analysis and scores for ranking and competitive features. When you create an account or use features that collect data, we obtain your consent through in-app permission prompts, account registration flows, and device-level permission dialogs. By using Sacky, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, do not use the App.
1. Scope of This Policy
This Privacy Policy applies to the Sacky mobile app, related websites (including https://sacky.app/privacy.html and https://sacky.app/terms.html), account systems, support communications, rankings, social features, video uploads, AI analysis features, and any related services operated by Burke Digital LLC. It does not apply to third-party websites, platforms, app stores, social networks, or services we do not control, even if they link to or integrate with Sacky.
2. Information We Collect
2.1 Account Information
When you create or use an account, we may collect username, name, email address, password or authentication credentials (stored securely by our authentication provider), and optional school, team, group, or club affiliation (which may be user-submitted and unverified).
2.2 User Content and Social Activity
Videos, clips, images, captions, comments, and other content you upload; profile information and public-facing details; follow, follower, like, score, ranking, leaderboard, and interaction data; duel participation (solo and club), duel-clip submissions, votes cast on duels, and duel bonus points awarded; reports, flags, moderation decisions, appeals, and safety-related communications.
2.3 Camera, Photo Library, and Microphone
With your permission, the App may access your camera, photo library, video library, and microphone so you can record, upload, or share videos. Access is limited to App functionality and subject to device permissions you control. You may revoke these permissions at any time through your device settings; doing so may limit App functionality.
2.4 AI Analysis Data
Sacky uses artificial intelligence (including third-party models such as Google Gemini) to analyze uploaded videos. This includes processing visual movement, video frames, timing, trick performance, motion patterns, and related metadata to generate scores, grades, rankings, and feedback. AI outputs may be inaccurate, subjective, incomplete, or inconsistent.
2.5 Usage, Device, and Technical Data
App interactions, feature usage, session activity; device type, operating system, app version, language settings, crash logs; IP address (collected for security, fraud prevention, and diagnostic purposes only — we do not use IP address to determine or store your location); timestamps, and diagnostic information; performance, fraud-prevention, security, analytics, and error-reporting data.
2.6 Payment and Subscription Information
Sacky Pro subscriptions ($4.99/week, auto-renewing) are processed by Apple. We use RevenueCat to manage subscription entitlements. We may receive limited purchase-related information such as subscription status, product purchased, renewal status, transaction identifiers, and entitlement data. We do not receive full payment card numbers from Apple.
2.7 Communications
If you contact us for support, submit feedback, report content, request deletion, or otherwise communicate with us, we may collect your email address, message content, attachments, and related information.
2.8 Contest and Prize Information
If you participate in a Sacky contest or tournament, we may use your account information, uploaded clips, scores, leaderboard position, and related activity to administer the contest, verify eligibility, determine winners, prevent cheating, and award prizes. If you win a physical prize, we may collect additional information, such as your name, mailing address, contact information, and, if required, parent or guardian confirmation, solely to verify eligibility and deliver the prize.
3. How We Use Information
- Create, maintain, authenticate, and secure user accounts
- Allow users to upload, view, share, comment on, follow, and interact with videos and accounts
- Generate AI-assisted scores, rankings, leaderboards, grades, feedback, and performance analysis
- Display user profiles, public content, comments, scores, rankings, and social interactions
- Moderate and filter content, enforce rules, review reports, detect abuse, and protect users
- Provide customer support and respond to requests, complaints, or legal notices
- Improve App performance, reliability, safety, design, features, analytics, and user experience
- Manage subscriptions, paid features, entitlements, refunds, and purchase-related support
- Send service-related notices, policy updates, security alerts, and support messages
- Comply with laws, legal processes, and enforceable government or legal requests
4. User Content, Ownership, and Public Visibility
Users retain ownership of the videos and content they upload. However, content uploaded to Sacky may be visible to other users or the public depending on product and account settings, ranking and sharing features, and how the App is configured. By uploading content, you understand that other users may view, interact with, comment on, report, or share that content. Do not upload content you do not want others to see. As described in the Sacky Terms of Service, uploaded content may also be used by Sacky and Burke Digital LLC for promotional, marketing, product, highlight, ranking, compilation, and App-related purposes, subject to the license described in the Terms.
5. Third-Party Service Providers (Sub-Processors)
Sacky uses the following third-party providers to operate the App. Each receives only the data necessary to perform its function and is contractually required to protect that data.
- Supabase — backend hosting, authentication, database, and file storage. Stores account information, user content, and app data. Privacy: supabase.com/privacy
- Apple App Store / Apple Inc. — app distribution, payment processing, and subscription billing. Privacy: apple.com/legal/privacy
- RevenueCat — subscription entitlement management for Sacky Pro. Receives transaction identifiers and entitlement data. Privacy: revenuecat.com/privacy
- Google (Gemini API) — AI processing of uploaded videos to generate scores, feedback, and content safety screening. Video frames may be transmitted for analysis. Privacy: policies.google.com/privacy
- Lovable Cloud — managed infrastructure and cloud deployment platform used to host and deploy backend services. Receives application code and encrypted backend traffic; does not independently access user personal data. Privacy: lovable.dev/privacy
We may add or replace sub-processors from time to time and will update this Privacy Policy accordingly.
6. How We Share Information
We do not sell your personal data. We may share information only as described below:
- With other users or the public when you upload content, comment, follow users, appear in rankings, or use social features
- With the service providers listed in Section 5, acting on our behalf
- With app stores, payment processors, and subscription providers as needed to manage purchases, subscriptions, entitlements, and refunds
- With legal authorities, regulators, courts, or other parties when required by law or when we believe disclosure is necessary to comply with legal obligations, enforce our Terms, protect rights, protect users, prevent fraud, or address safety issues
- In connection with a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or transfer of all or part of our business, subject to appropriate protections where required by law
- With your consent or at your direction
7. Data We Do Not Sell
Burke Digital LLC does not sell users' personal data. We do not sell user videos, emails, names, school or club affiliations, comments, follower data, or AI scoring data to data brokers or any other third party.
8. Cookies, Analytics, and Similar Technologies
Sacky does not use third-party analytics, advertising SDKs, or cross-app tracking technologies. Sacky does not track you across other companies' apps or websites and does not present an App Tracking Transparency prompt. If you access Sacky-related web pages (such as sacky.app/privacy.html or sacky.app/terms.html), those pages may use standard web server logs, but we do not use advertising cookies, third-party trackers, or behavioral analytics on those pages. You may limit certain device-level controls through your device settings or Apple privacy controls.
9. Data Retention
We retain information for as long as reasonably necessary to provide Sacky, maintain accounts, provide social and ranking features, comply with legal obligations, resolve disputes, enforce agreements, prevent abuse, maintain security, and support legitimate business purposes. When you delete your account or request deletion, we will take reasonable steps to delete or de-identify personal information within 30 days, subject to legal, safety, backup, fraud-prevention, dispute, accounting, and technical limitations. Some public or shared content may remain visible if it was copied, shared, featured, cached, incorporated into rankings, or retained as necessary for legal or safety reasons.
10. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including encryption in transit, row-level security on database tables, and access controls. However, no app, network, storage system, or transmission method is completely secure. Users are responsible for using strong account credentials, protecting their devices, and avoiding unauthorized account access.
11. Children and Teen Users (COPPA and GDPR-K)
Sacky is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without legally valid parental consent, we will take reasonable steps to delete it promptly. If you are a parent or guardian and believe your child under 13 has provided personal information to us, contact BurkeDigitalLLC@gmail.com and we will delete the information.
By creating an account, you confirm that you are at least 13 years old. If you are between 13 and 18, you confirm that you have permission from a parent or legal guardian to use Sacky. We rely on this self-confirmation to screen for eligibility. Users between 13 and 17 are subject to age-appropriate settings where applicable. As Sacky contains no content exceeding a 13+ rating, no additional feature restrictions are currently applied to teen users beyond standard COPPA protections. If we have reason to believe a user is under 13, we may suspend or terminate that account. Parents or guardians may contact us at BurkeDigitalLLC@gmail.com to request review or deletion of information associated with a minor.
EU Users — GDPR Article 8 (GDPR-K). If you are located in the European Union or European Economic Area, the processing of personal data in Sacky is subject to GDPR Article 8, commonly referred to as GDPR-K. The GDPR sets the default digital age of consent for information society services at 16 years old; however, individual EU member states may lower this threshold to a minimum of 13. Where the applicable digital age of consent in your EU member state is higher than 13, and you are below that age, we require verifiable parental or guardian consent before your personal data is processed by Sacky.
If you are a parent or legal guardian of an EU-based user who is below your country's applicable digital age of consent, you have the right to: (a) provide, withdraw, or revoke consent for your child's data processing at any time; (b) access and review personal data collected from your child; (c) request correction of inaccurate data; (d) request erasure of your child's personal data (right to be forgotten); and (e) restrict or object to certain processing of your child's data. To exercise any of these rights, contact us at BurkeDigitalLLC@gmail.com. We will not knowingly process the personal data of an EU user below the applicable digital age of consent without verifiable parental or guardian consent. Privacy communications directed at child users are written in clear, plain, and age-appropriate language as required by GDPR Article 12 and Recital 58.
12. User-Generated Content Safety
Sacky enforces a zero-tolerance policy for objectionable content and abusive behavior. The App employs layered filtering: automated AI screening before clips are published and a community report threshold that auto-hides clips pending admin review after 3 or more distinct reporters, in addition to human review. Users can report any post, comment, or profile through the in-app report flow, and can block other users directly from their profile. We commit to reviewing reports of objectionable content and acting on them (by removing the content and/or ejecting the user) within 24 hours of receipt. See the Terms of Service for full details.
13. Your Choices and Rights
Depending on your location and applicable law, you may have rights to access, correct, delete, export, or object to certain processing of your personal information. You may also request account deletion or ask privacy-related questions by contacting BurkeDigitalLLC@gmail.com. You can also control device permissions (camera, photo library, microphone, notifications, tracking) through your device settings. Disabling permissions may limit App functionality. Where you have provided consent for data collection, you may revoke that consent at any time through your device permission settings or by contacting us; revocation does not affect processing already lawfully completed.
Restricted Mode. Sacky includes an optional Restricted Mode toggle available in Settings. When enabled, Restricted Mode automatically hides from your view any clips that have been flagged or reported at least once. Restricted Mode does not affect what other users see and does not change how your own content is displayed to others. It is a personal content filtering control that you can enable or disable at any time through Settings.
14. State, National, and International Privacy Rights
Privacy laws may provide additional rights depending on where you live, including rights under California (CCPA/CPRA), other U.S. state privacy laws, the EU/UK General Data Protection Regulation (GDPR), or other international privacy laws. If you make a rights request, we may need to verify your identity before responding. We will not discriminate against you for exercising privacy rights where prohibited by law. If personal information is transferred, stored, or processed outside your state, province, or country, we will handle it in accordance with this Privacy Policy and applicable law.
Sacky does not sell or share personal information as those terms are defined under the CCPA/CPRA, including for cross-context behavioral advertising. No opt-out mechanism is required because we do not engage in these activities. Sacky does not collect precise geolocation, biometric identifiers, health data, or financial account information.
EU/EEA and UK Users. If you are located in the EU, EEA, or United Kingdom, you have additional rights under the GDPR and UK GDPR, including the right to access your personal data, rectify inaccurate data, request erasure (right to be forgotten), restrict processing, data portability, and to object to processing based on legitimate interests. You also have the right to lodge a complaint with your local data protection supervisory authority. For children's data specifically, see Section 11 (GDPR-K) for parent and guardian rights. Lawful Basis for Processing (GDPR Article 6). For users in the EU/EEA, we process personal data on the following lawful bases: (a) contract performance — to provide and maintain your account and the App's core features; (b) legitimate interests — to improve the App, prevent fraud, ensure safety, and enforce our Terms (balanced against your rights and freedoms); (c) consent — for optional features such as camera and photo library access, contest participation, and promotional communications; and (d) legal obligations — to comply with applicable laws, regulations, and enforceable government requests. You may withdraw consent at any time through your device settings or by contacting us; withdrawal does not affect processing already lawfully completed.
International Data Transfers. Sacky is operated from the United States. If you are located outside the United States, your personal data will be transferred to and processed in the United States. When personal data is transferred from the EU/EEA or United Kingdom to the United States, we rely on Standard Contractual Clauses approved by the European Commission, or other lawful transfer mechanisms recognized under applicable data protection law, to ensure an adequate level of protection for your personal data.
15. Third-Party Links and Services
Sacky may contain links to third-party websites, app stores, social networks, payment systems, analytics tools, or other services. We are not responsible for the privacy practices of third parties. Review their privacy policies before using those services.
16. Account Deletion and Data Requests
You may delete your account directly within Sacky under Settings → Account → Delete Account, or by emailing BurkeDigitalLLC@gmail.com. Include enough information for us to identify your account. We may retain limited information when necessary for legal compliance, fraud prevention, security, dispute resolution, financial records, or enforcement of our Terms.
17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we may provide notice through the App, by email, or by updating the Last Updated date above. Continued use of Sacky after an update means you acknowledge the updated Privacy Policy. The current Privacy Policy is always available at https://sacky.app/privacy.html.
