Sacky is owned and operated by Burke Digital LLC ("we," "us," "our").
1. Acceptance of Terms
By accessing or using Sacky ("the App"), you agree to these Terms.
2. Eligibility
You must be at least 13 years old. If under 18, you must have parental/guardian consent.
3. Accounts
You may provide:
- Username
- Name
- Optional school/club
You are responsible for all activity under your account.
4. User Content Ownership
You retain full ownership of any videos, clips, or content ("User Content") you upload.
5. License to Sacky
By uploading content, you grant Burke Digital LLC a worldwide, perpetual, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Host, store, reproduce, and display content
- Publicly perform and distribute content
- Use content for marketing, promotion, advertising, and platform growth
- Create derivative works including highlights, rankings, edits, compilations
- Use content in social media, ads, and promotional materials
This license survives account deletion to the extent content has been shared or incorporated into platform features.
6. AI Processing & Usage
You acknowledge and agree that:
- Your uploaded videos may be processed using artificial intelligence models
- AI may analyze motion, patterns, and performance
- AI outputs (scores, rankings, insights) are generated automatically
- AI systems may use your content to improve performance, accuracy, and features
You grant Burke Digital LLC the right to:
- Process your content through AI systems
- Use anonymized or aggregated data derived from your content for model improvement
- Store and analyze content for algorithm development
AI results:
- Are not guaranteed accurate
- Are subjective and experimental
- Do not constitute professional or official judgment
7. Content Restrictions
You may not upload content that:
- Violates laws
- Infringes intellectual property
- Is abusive, harmful, or misleading
- Contains explicit or unsafe material
8. Moderation Rights
We reserve full discretion to:
- Remove or edit content
- Restrict visibility
- Suspend or terminate accounts
- Enforce platform rules without notice
9. Intellectual Property
All platform software, branding, and systems are owned by Burke Digital LLC.
10. Third-Party Services
We may use third-party providers (AI, hosting, analytics). We are not responsible for their actions.
11. Termination
We may terminate or suspend access at any time.
12. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties.
13. Limitation of Liability
To the fullest extent permitted by law, Burke Digital LLC shall not be liable for:
- Indirect or consequential damages
- Loss of data or content
- User-generated content or interactions
- AI inaccuracies or decisions
14. Indemnification
You agree to indemnify and hold harmless Burke Digital LLC from claims arising from:
- Your content
- Your use of the App
- Your violation of these Terms
15. Governing Law
These Terms are governed by the laws of Maine, United States.
16. Changes
We may update these Terms at any time.
